These Terms of Service (“Terms”) govern your access to and use of the Heritage website, online store, and services (collectively, the “Site”). By visiting or purchasing from the Site, you agree to these Terms and our Privacy Policy, Shipping & Delivery, and Returns & Exchanges policies.

1) Eligibility & Accounts

  • You must be at least 18 years old (or have parent/guardian consent) to purchase.

  • You are responsible for all activity on your account and for keeping your login secure.

  • We may refuse service, suspend, or close accounts at our discretion (e.g., suspected fraud or abuse).

2) Products, Pricing & Orders

  • All prices are in AUD and inclusive of GST where applicable, unless stated otherwise.

  • We may change prices, product availability, and descriptions at any time.

  • Placing items in your cart does not reserve them. Your order is accepted only when we send an Order Confirmation email.

  • We may cancel or limit quantities (e.g., suspected reseller activity, stock errors). If cancelled after payment, you’ll be refunded.

  • Colours & Sizing: We aim for accurate photos and measurements; however, variations can occur due to screens, lighting, and natural material differences.

  • Made-to-Order/Pre-Order: Estimated timelines are provided as guidance; small variances may occur.

3) Payment & Billing

  • We accept the payment methods displayed at checkout. By paying, you confirm you’re authorised to use the chosen method.

  • Orders may be subject to security checks and verification. We may contact you or your payment provider for confirmation.

4) Shipping, Delivery & Risk

  • We ship according to our Shipping & Delivery policy.

  • Risk of loss passes to you upon delivery to the shipping address provided. Title transfers once full payment is received.

  • International customers are responsible for any import duties, taxes, and customs fees.

5) Returns, Exchanges & Change-of-Mind

  • See our Returns & Exchanges policy for return windows, conditions, and what is/ isn’t eligible.

  • For change-of-mind returns, return postage is typically paid by the customer unless our policy states otherwise.

  • To start a return, follow the process on our Contact page with your order details.

6) Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any rights, guarantees, or remedies you have under the Australian Consumer Law. If a product fails to meet a consumer guarantee, you are entitled to a repair, replacement, or refund as required by law.

7) Promotions, Gift Cards & Store Credit

  • Promotions and discount codes apply to eligible orders as stated in the offer and cannot be combined unless specified.

  • Gift cards and store credits are non-refundable and not redeemable for cash (unless required by law). Treat them like cash; lost or stolen balances may not be replaced.

8) Intellectual Property

  • The Site, its content, product designs, photographs, text, graphics, logos, and trademarks are owned by or licensed to Heritage and are protected by IP laws.

  • You may not copy, reproduce, adapt, publish, or exploit any part of the Site or our content without prior written consent.

9) User Content & Reviews

  • If you submit reviews, photos, or other content (“User Content”), you grant Heritage a non-exclusive, worldwide, royalty-free licence to use, reproduce, and display that content for marketing and operational purposes.

  • You must own or have rights to the content you post and ensure it is accurate, lawful, and not misleading, defamatory, or infringing.

  • We may moderate or remove User Content at our discretion.

10) Acceptable Use

You agree not to:

  • Interfere with the Site’s security, functionality, or infrastructure.

  • Use automated scraping, data mining, or similar tools without permission.

  • Upload malicious code or attempt unauthorised access.

  • Use the Site for unlawful, harmful, or abusive activity.

11) Third-Party Services & Links

  • The Site may link to or integrate third-party services (e.g., payment gateways, couriers, social platforms). We’re not responsible for their content, policies, or practices. Use them at your own risk and review their terms.

12) Availability & Changes

  • We aim for continuous access but do not guarantee the Site will be uninterrupted, timely, or error-free.

  • We may update, suspend, or discontinue any part of the Site without notice.

  • We may update these Terms at any time. Changes take effect when posted on the Site. Your continued use constitutes acceptance.

13) Limitation of Liability

  • To the maximum extent permitted by law, Heritage is not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.

  • To the extent permitted by law, our aggregate liability for any claim arising out of or related to the Site, products, or these Terms is limited to the amount you paid for the relevant order (or $100 AUD if the claim does not relate to a purchase).

  • This section does not limit remedies available to you under the ACL.

14) Indemnity

You agree to indemnify and hold Heritage and its officers, employees, and agents harmless from and against any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

15) Privacy & Cookies

  • We handle personal information in accordance with our Privacy Policy.

  • The Site may use cookies and similar technologies; by using the Site, you consent to their use as described in our policy.

16) Force Majeure

We are not liable for delays or failures caused by events beyond our reasonable control (e.g., natural disasters, pandemics, acts of government, strikes, supply chain disruptions).

17) Governing Law & Disputes

  • These Terms are governed by the laws of New South Wales, Australia.

  • You submit to the exclusive jurisdiction of the courts of NSW and the Commonwealth of Australia.

  • If you have a concern, please contact us first so we can try to resolve it informally.

18) Severability & Entire Agreement

  • If any provision is deemed unlawful or unenforceable, it will be severed and the remainder will continue in effect.

  • These Terms, together with the policies referenced, constitute the entire agreement between you and Heritage regarding the Site and services.
